Submission to the Australian Competition and Consumer Commission (ACCC) on Unsolicited selling and lead generation practices

Our submission supports a ban on unsolicited selling practices, to protect people from harm and ensure the energy market remains fair, trusted and inclusive.

We support a national ban on unsolicited selling practices.

High-pressure sales tactics and aggressive lead generation are harming consumers and undermining trust in the energy market. Our submission to the Australian Competition and Consumer Commission (ACCC) supports the designated complaint made by Consumer Action Law Centre and calls for a clear, nationally consistent ban on unsolicited selling of rooftop solar, batteries and other consumer energy technologies.

These practices can lead people to sign up for products they don’t understand or can’t afford, especially those in vulnerable circumstances. 

Without intervention, negative consumer experiences will continue to accumulate, eroding confidence in consumer energy resource (CER) products and services and the energy transition more broadly.

We also call for expanded consumer protections, including clearer rules for marketers and stronger dispute resolution pathways. This should include extending the jurisdiction of energy ombudsman schemes to cover emerging CER product and services.

A ban on unsolicited selling is essential to protect people from harm and ensure the energy market remains fair, trusted and inclusive.
